Canadian fined $42,000 for telling a joke; Wyoming judge fined for $40,000 for not endorsing ‘same-sex marriage’

Noticed the following news story several hours ago:

It’s called the Human Rights Tribunal, but this Canadian government agency could easily be mistaken for the censorship-enforcement arm of an authoritarian country. The tribunal recently fined comedian Mike Ward $42,000 for telling a joke that some people found offensive.

The joke concerned Jeremy Gabriel, a 19-year-old Canadian singer who suffers from Treacher Collins Syndrome, a debilitating disease. Ward’s joke was that the constant media coverage of Gabriel overlooks the fact that “he was supposed to die… why isn’t he dead yet?” Ward suggests that Gabriel “stole a wish” and is now, in fact, unkillable.

When Gabriel’s family heard about the joke, they called the Human Rights Tribunal, according to Spiked magazine. Ward then fought them in court, and lost. He has to pay a $42,000 fine: $35,000 to Gabriel, and $7,000 to Gabriel’s mother.

Ward told Spiked magazine that he’s appealing the decision. He says that if he ultimately loses the case, he will “just move to Syria or Saudi Arabia or some other country the respects free speech as much as Canada does.”

Gabriel was disappointed to learn that Ward was appealing.

“In this case, freedom of expression is a false debate,” Gabriel told CTV News. “When you use discriminatory motives that incite hatred, you can’t talk about freedom of expression.”

That was the judge’s thinking, too.

“Unacceptable remarks made in private do not automatically become lawful just because they’re made by a comedian in the public domain,” wrote Judge Scott Hughes in his decision forcing Ward to pay Gabriel. “Plus, having a such a platform imposes certain responsibilities.”

Ward’s mistreatment is a reminder of the importance of the First Amendment—something that doesn’t apply in Canada. While I have a disabled child, and consider the joke to be in poor taste, the judge’s ruling in Canada is  of concern. A massive fine for telling a joke some find offensive?

If that is the standard, then all comedians are at risk.

But it is not just comedians.

And it is not just Canadians.

In the past year or so, the first amendment of the USA has gotten trashed by various governments and courts in the USA. That amendment states:

  • First amendment — Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

While the USA is supposed to have freedom of speech and freedom of religion, that is becoming less and less the case.

Now there’s a new fight, brought by several individuals who say they have the right under the Religious Freedom Restoration Act to pray on the plaza, or to speak against the death penalty there.

The federal government has submitted a brief to the judge explaining that no, they do not.

The DOJ alleges that John Payden-Travers and Midgelle Potts have not established that their faith compels them to speak or pray “on the plaza.” Or that the government has “substantially” burdened them.

“A ‘substantial burden’ exists only ‘when government action puts substantial pressure on an adherent to modify his behavior and to violate his beliefs,’” the DOJ told the judge. “An inconsequential or de minimis burden on religious practice does not rise to this level, nor does a burden on activity unimportant to the adherent’s religious scheme.”

The government argues that a ban on religious expression at this location was unimportant, so the case should be dismissed.

So, the US federal government is arguing it can have laws to prevent freedom of speech, the right of people to peaceably assemble, and to pray for the government to change policy. Do Americans see what keeps happening?

The state Supreme Court in Wyoming is considering charges that a municipal judge should be banned from the judiciary permanently and fined $40,000 for following the tenets of her Lutheran faith regarding marriage.

The claims against Judge Ruth Neely, a municipal judge in the small town of Pinedale as well as a part-time circuit court magistrate, were brought by the Wyoming Commission on Judicial Conduct and Ethics.

The state agency got involved after a local reporter, upon the U.S. Supreme Court’s creation of same-sex “marriage,” asked Neely whether she was excited to perform such ceremonies.

Well, no, the judge responded, because her faith wouldn’t allow her to do that. …

The issue is that Neely is not allowed to solemnize marriages in her role as a municipal judge. And while she is allowed to do so as a magistrate, it is not required of her. There is no pay for it, and magistrates can decline for personal reasons.

“It takes real chutzpah for the government to come in like the Keystone Kops but still ask an innocent judge to pay the price,” Becket Fund legal counsel Daniel Blomberg said as the case developed.

“If you ask the people of Pinedale, they say that Judge Neely has served the town with fairness and integrity for decades, and that they want to keep her. Notice that supposedly, Judge Neely is not required to solemnize weddings, yet was fined for saying she would not do so for so-called ‘same-sex marriages.’

The USA and Canada are going in the wrong direction.

Fining people, and even the implicit threat of doing so, for speech that was not intended to deceive (people realize that a comedian is telling a joke, not making public policy) is a police-state tactic.

Notice something that Jesus said:

4 … the night is coming when no one can work. (John 9:4, NKJV)

4… the night cometh, when no man can work (John 9:4 KJV)

In a October 23, 1980 co-worker letter, the late Herbert W. Armstrong wrote:

The Bible warns us the time is just ahead when NO MAN CAN WORK—in the Lord’s Work. We must sacrifice now as never before for this Work that we may FINISH the Work that Christ has called us to do. Pray as never before, for this Work.

We are getting closer to that time.

Notice also something that the Prophet Amos was inspired to record:

11 “Behold, the days are coming,” says the Lord God,
“That I will send a famine on the land,
Not a famine of bread,
Nor a thirst for water,
But of hearing the words of the Lord.
12 They shall wander from sea to sea,
And from north to east;
They shall run to and fro, seeking the word of the Lord,
But shall not find it. (Amos 8:11-12)

Governmental persecution will eventually stop the ‘short work’ (Romans 9:28) and lead to that ‘famine of the word’ (see also Preparing for the ‘Short Work’ and The Famine of the Word).

In the USA and Canada pornography is normally considered to be ‘protected speech,’ yet now stating a long held religious view or telling a joke can get one fined.

The USA is going in the wrong direction, and so is Canada. National repentance is the only way to prevent their destruction, and that does not look likely.

The advocacy of homosexuality and abortion, increased indebtedness, anti-religious and anti-speech actions, and acceptance of various forms of pornography that we have seen the past few years suggests that national repentance is about the furthest thing on the minds of the national political leaders and most of the mainstream media in the USA and Canada.

Personal repentance, however, is still possible. If you are a North American, your personal future can still be much brighter than that of your country. The USA, along with Canada, will be destroyed (cf. Daniel 11:39; Habakkuk 2:6-8).
