\nSubject: Foreign Intelligence Surveillance Act Abuses at the Department of Justice and the Federal Bureau of Investigation<\/p>\n
Purpose<\/u><\/strong><\/p>\n This memorandum provides Members an update on significant facts relating to the Committee\u2019s ongoing investigation into the Department of Justice (DOJ) and Federal Bureau of Investigation (FBI) and their use of the Foreign Intelligence Surveillance Act (FISA) during the 2016 presidential election cycle. Our findings, which are detailed below, 1) raise concerns with the legitimacy and legality of certain DOJ and FBI interactions with the Foreign Intelligence Surveillance Court (FISC), and 2) represent a troubling breakdown of legal processes established to protect the American people from abuses related to the FISA process.<\/p>\n Investigation Update<\/u><\/strong><\/p>\n On October 21, 2016, DOJ and FBI sought and received a FISA probable cause order (not<\/u> under Title VII) authorizing electronic surveillance on Carter Page from the FISC. Page is a US citizen who served as a volunteer advisor to the Trump presidential campaign. Consistent with requirements under FISA, the application had to be first certified by the Director or Deputy Director of the FBI. It then required the approval of the Attorney General, Deputy Attorney General (DAG), or the Senate-confirmed Assistant Attorney General for the National Security Division.<\/p>\n The FBI and DOJ obtained one initial FISA warrant targeting Carter Page and three FISA renewals from the FISC. As required by statute (50 U.S.C. 1805(d)(1)), a FISA order on an American citizen must be renewed by the ISC every 90 days and each renewal requires a separate finding of probable cause. Then-Director James Comey signed three FISA applications in question on behalf of the FBI, and Deputy Director Andrew McCabe signed one. Sally Yates, then-Acting DAG Dana Boente, and DAG Rod Rosenstein each signed one or more FISA applications on behalf of DOJ.<\/p>\n Due to the sensitive nature of foreign intelligence activity, FISA submissions (including renewals) before the ISC are classified. As such, the public\u2019s confidence in the integrity of the FISA process depends on the court\u2019s ability to hold the government to the highest standard — particularly as it relates to surveillance of American citizens. However, the rigor in protecting the rights of Americans, which is reinforced by 90-day renewals of surveillance orders, is necessarily dependent on the government\u2019s production to the court of all material and relevant facts. This should include information potentially favorable to the target of the FISA application that is known by the government. In the case of Carter Page, the government had at least four independent opportunities before the FISC to accurately provide an accounting of the relevant facts. However, our findings indicate that, as described below, material and relevant information was omitted.<\/p>\n 1) The \u201cdossier\u201d compiled by Christopher Steele (Steele dossier) on behalf of the Democratic National Committee (DNC) and the Hillary Clinton campaign formed an essential part of the Carter Page FISA application. Steele was a longtime FBI source who was paid over $160,000 by the DNC and Clinton campaign, via the law firm Perkins Coie and research firm Fusion GPS, to obtain derogatory information on Donald Trump\u2019s ties to Russia.<\/p>\n a) Neither the initial application in October 2016, nor any of the renewals, disclose or reference the role of the DNC, Clinton campaign, or. any party\/campaign in funding Steele\u2019s efforts, even though the political origins of the Steele dossier were then known to senior and FBI officials.<\/p>\n b) The initial FISA application notes Steele was working for a named US. person, but does not name Fusion GPS and principal Glenn Simpson, who was paid by a US. Law firm (Perkins Coie) representing the DNC (even though it was known by DOI at the, time that political actors were involved with the Steele dossier). The application does not mention Steele was ultimately working on behalf of — and paid by — the DNC and Clinton campaign, or that the FBI had separately authorized payment to Steele for the same information.<\/p><\/blockquote>\n 2) The Carter Page FISA application also cited extensively a September 23, 2016, Yahoo News<\/em> article by Michael Isikoff, which focuses on Page\u2019s July 2016 trip to Moscow. This article does not corroborate the Steele dossier because it is derived from information leaked by Steele himself to Yahoo News<\/em>. <\/u>The Page FISA application incorrectly assesses that Steele did not directly provide information to Yahoo News. Steele has admitted in British court filings that he met with Yahoo News — and several other outlets \u2013 in September 2016 at the direction of Fusion GPS. Perkins Coie was aware of Steele\u2019s initial media contacts because they hosted at least one meeting in Washington DC. in 2016 with Steele and Fusion GPS where this matter was discussed.”<\/p>\n a) Steele was suspended and then terminated as an FBI source for what the FBI defines as the most serious of violations — an unauthorized disclosure to the media of his relationship with the FBI in an October 30, 2016, Mother Jones<\/em> article by David Corn. Steele should have been terminated for his previous undisclosed contacts with Yahoo and other outlets in September<\/strong> — before the Page application was submitted to the FISC in October — but Steele improperly concealed from and lied to the FBI about those contacts.<\/p>\n b) Steele\u2019s numerous encounters with the media violated the cardinal rule of source handling — maintaining confidentiality — and demonstrated that Steele had become a less than reliable source for the FBI.<\/p><\/blockquote>\n a) During this same time period, Ohr\u2019s wife was employed by Fusion GPS to assist in the cultivation of opposition research on Trump. Ohr later provided the FBI with all of his wife\u2019s opposition research, paid for by the DNC and Clinton campaign via Fusion GPS. The Ohrs\u2019 relationship with Steele and Fusion GPS was inexplicably concealed from the FISC.<\/p><\/blockquote>\n 4) According to the head of the counterintelligence division, Assistant Director Bill Priestap, corroboration of the Steele dossier was in its \u201cinfancy\u201d at the time of the initial Page FISA application. After Steele was terminated, a source validation report conducted by an independent unit within FBI assessed Steele\u2019s reporting as only minimally corroborated. Yet, in early January 2017, Director Comey briefed President-elect Trump on a summary of the Steele dossier, even though it was — according to his June 2017 testimony \u2013 \u201csalacious and unverified.\u201d While the FISA application relied on Steele\u2019s past record of credible reporting on other unrelated matters, it ignored or concealed his 5) The Page FISA application also mentions information regarding fellow Trump campaign advisor George Papadopoulos, but there is no evidence of any cooperation or conspiracy between Page and Papadopoulos. The Papadopoulos information triggered the opening of an FBI counterintelligence investigation in late July 2016 by FBI agent Pete Strzok. Strzok was reassigned by the Special Counsel\u2019s Office to FBI Human Resources for improper text messages with his mistress, FBI Attorney Lisa Page (no known relation to Carter Page), where they both demonstrated a clear bias against Trump and in favor of Clinton, Whom Strzok had also investigated. The Strzok\/Lisa Page texts also reflect extensive discussions about the investigation, orchestrating leaks to the media, and include a meeting with Deputy Director McCabe to discuss an \u201cinsurance\u201d policy against President Trump\u2019s election. https:\/\/www.washingtonpost.com\/news\/the-fix\/wp\/2018\/02\/02\/the-full-nunes-memo-annotated\/?utm_term=.8f3b5caf6f89 The Steel dossier contained falsehoods and, thus, the FISA investigation was started at least partially because of lies. Officials in the FBI and Justice department saw the partisan angle, but proceeded anyway.<\/p>\n Donald Trump has been contending since 2016 that the government was not investigating Hillary Clinton related to her email and other scandals in an unbiased manner, but that he was being treated unfairly.<\/p>\n While we do not have all the facts related to this and various investigations, nor access to all the supporting materials, several things do seem to be apparent.<\/p>\n Here is my personal, non-legal, assessment of this and related matters:<\/p>\n As far as the ‘deep state’ situation, notice something from nearly a year ago:<\/p>\n February 19, 2017<\/p>\n The scariest new catchphrase of the Trump<\/a>era \u2013 and we\u2019re only one month in \u2013 is the \u201cdeep state,\u201d a term borrowed from countries like Turkey and Egypt, where networks of military officers and intelligence operatives control much of the government.<\/p>\n Last week, President Trump complained that \u201cillegal leaks\u201d from the FBI<\/a> and other intelligence agencies forced him to fire his national security advisor, Michael Flynn<\/a>.<\/p>\n The leaks revealed that Flynn had secretly discussed U.S. sanctions on Russia with the Russian ambassador, then falsely claimed he hadn\u2019t. The talks didn\u2019t bother Trump; the leaks did.<\/p>\n \u201cThe real scandal here is that classified information is illegally given out by \u2018intelligence\u2019 like candy,\u201d he tweeted. \u201cThe spotlight has finally been put on the low-life leakers! They will be caught!\u201d<\/p>\n Others worried, too. Republican members of Congress condemned the leaks as a misuse of classified information. Critics of the intelligence community, both conservative and liberal, warned that unelected bureaucrats were exerting too much political power.<\/p>\n Was the American deep state, panicked by Trump, revealing itself?<\/p>\n \u201cThe intelligence agencies are pretty hard to roll,\u201d a former top CIA official told me last week. \u201cThese guys are trained to manipulate people and overthrow governments, and they\u2019re rather good at it.\u201d …<\/p>\n Trump\u2019s problem isn\u2019t the deep state; it\u2019s the broad state. He\u2019s facing pushback not only from intelligence agencies, but from civilian bureaucracies, too. http:\/\/www.latimes.com\/opinion\/op-ed\/la-oe-mcmanus-deep-state-20170219-story.html<\/a><\/p>\n February 18, 2017<\/p>\n When Gen. Michael Flynn was forced to resign as national security adviser, Bill Kristol purred his satisfaction, \u201cIf it comes to it, prefer the deep state to the Trump state.\u201d<\/p>\n To Kristol, the permanent regime, not the elected president and his government, is the real defender and rightful repository of our liberties.<\/p>\n Yet it was this regime, the deep state, that carried out what Eli Lake of Bloomberg calls \u201cThe Political Assassination of Michael Flynn.\u201d …<\/p>\n But the deep state is after larger game than General Flynn. It is out to bring down President Trump and abort any move to effect the sort of rapprochement with Russia that Ronald Reagan achieved. http:\/\/www.app.com\/story\/opinion\/columnists\/2017\/02\/18\/buchanan-deep-state-targets-trump\/98064640\/<\/a><\/p>\n<\/div>\n<\/blockquote>\n While campaigning, Donald Trump spoke about his need to “drain the swamp.” By that, he meant various interests in (like government employees or politicians) or related to (like lobbyists and government contractors) the US federal government.<\/p>\n Many do not like that.<\/p>\n Some believe that Barack Obama took an action in early January 2017 to make an environment so that those in the government could leak information against Donald Trump:<\/p>\n 01\/12\/17<\/p>\n WASHINGTON \u2014 In its final days, the Obama administration has expanded the power of the National Security Agency to share globally intercepted personal communications with the government\u2019s 16 other intelligence agencies<\/a> before applying privacy protections.<\/p>\n The new rules significantly relax longstanding limits on what the N.S.A. may do with the information gathered by its most powerful surveillance operations, which are largely unregulated by American wiretapping laws. These include collecting satellite transmissions, phone calls and emails that cross network switches abroad, and messages between people abroad that cross domestic network switches. https:\/\/www.nytimes.com\/2017\/01\/12\/us\/politics\/nsa-gets-more-latitude-to-share-intercepted-communications.html?_r=1<\/a><\/p>\n 02\/18\/17<\/p>\n According to civil right expert and prominent First Amendement {sic} Supreme Court lawyer, Jay Sekulow<\/a>, what the agencies did by leaking the Trump Administration information was not only illegal but “almost becomes a soft coup”, one which was spurred by the last minute rule-change by Obama, who intentionally made it far easier for leaks to propagate, and next to impossible to catch those responsible for the leaks.<\/p>\n This is his explanation:<\/p>\n There was a sea-change here at the NSA with an order that came from president Obama 17 days before he left office where he allowed the NSA who used to control the data, it now goes to 16 other agencies and that just festered this whole leaking situation, and that happened on the way out, as the president was leaving the office.<\/p>\n Why did the Obama administration wait until it had 17 days left in their administration to put this order in place if they thought it was so important<\/strong>. They had 8 years, they didn’t do it, number one. Number two, it changed the exiting rule which was an executive order dating back to Ronald Reagan, that has been in place until 17 days before the Obama administration was going to end, that said the NSA gets the raw data, and they determine dissemination.<\/p>\n Instead, this change that the president put in place, signed off by the way by James Clapper on December 15, 2016, signed off by Loretta Lynch the Attorney General January 3, 2017, they decide that now 16 agencies can get the raw data and what that does is almost creates a shadow government<\/strong>. You have all these people who are not agreeing with President Trump’s position, so it just festers more leaks.<\/p>\n If they had a justification for this, wonderful, why didn’t they do it 8 years ago, 4 years ago, 3 years ago. Yet they wait until 17 days left. <\/strong><\/p><\/blockquote>\n One potential answer: they knew they had a “smoking gun”, and were working to make it easier to enable the information to be “leaked” despite the clearly criminal consequences of such dissemination.<\/p>\n As this point Hannity correctly points out, “it makes it that much more difficult by spreading out the information among 16 other agencies, if they want to target or take away the privacy rights, and illegally tap the phones, in this case General Flynn, it’s going to be much harder to find the perpetrator.”<\/p>\n Sekulow confirms, noting that back when only the NSA had access to this kind of raw data, there would be a very small amount of people who have access to this kind of data. “But this change in the Obama Administration was so significant that they allowed dissemination to 16 other agencies, and we wonder why there’s leaks.” http:\/\/www.zerohedge.com\/news\/2017-02-18\/jay-sekulow-obama-should-be-held-accountable-soft-coup-attempt-against-trump<\/a><\/p><\/blockquote>\n This is not unexpected. And leaks, via James Comey, to name one 2017 ‘leaker’ did occur.<\/p>\n Notice the following from the Bible:<\/p>\n 1 Hear my voice, O God, in my meditation; 5 They encourage themselves in an evil matter; We are seeing more and more the result of “secret plots” involving “bitter words.”<\/p>\n The so-called “deep state” in this case is essentially government bureaucrats, along with their willing accomplices in the mainstream media, that feel that they should change the Trump Administration.<\/p>\n From what seems known, in certain instances this has been done in ways that are illegal, partisan, and\/or improper.<\/p>\n Notice some biblical prophecies:<\/p>\n 25 There shall be terror within<\/strong> (Deuteronomy 32:25)<\/p>\n 1 But know this, that in the last days perilous times will come: 2 For men will be lovers of themselves<\/strong>, lovers of money, boasters, proud<\/strong>, blasphemers, disobedient to parents, unthankful, unholy, 3 unloving, unforgiving, slanderers, without self-control, brutal, despisers of good, 4 traitors, headstrong, haughty, lovers of pleasure rather than lovers of God<\/strong>, 5 having a form of godliness but denying its power. And from such people turn away! 6 For of this sort are those who creep into households and make captives of gullible women loaded down with sins, led away by various lusts, 7 always learning and never able to come to the knowledge of the truth<\/strong>. (2 Timothy 3:1-7)<\/p>\n 13 \u2026 evil men and impostors will grow worse and worse, deceiving and being deceived.
