WASHINGTON \u2014 Supreme Court Justice Samuel Alito on Thursday sounded an alarm about restrictions imposed because of the coronavirus pandemic, saying they shouldn’t become a “recurring feature after the pandemic has passed.”<\/p>\n

“The pandemic has resulted in previously unimaginable restrictions on individual liberty,” Alito said in an address to the conservative Federalist Society, which is holding its annual convention virtually because of the pandemic. …<\/p>\n

Alito was particularly critical of two cases earlier this year where the court sided with states that, citing the coronavirus pandemic, imposed restrictions on the size of religious gatherings. Alito, 70, told a Federalist Society virtual convention that \u201cwe have never before seen restrictions as severe, extensive and prolonged<\/strong> as those experienced, for most of 2020.\u201d<\/p>\n

\u201cThink of all the live events that would otherwise be protected by the right to freedom of speech:<\/strong> live speeches, conferences, lectures, meetings. Think of worship services, churches closed on Easter Sunday, synagogues closed for Passover on Yom Kippur. Think about access to the courts, or the constitutional right to a speedy trial. Trials in federal courts have virtually disappeared in many places. Who could have imagined that?\u201d he said.<\/p>\n

\u201cThe COVID crisis has served as a sort of constitutional stress test. And in doing so it has highlighted disturbing trends that were already present before the virus struck.\u201d<\/strong><\/p><\/blockquote>\n

One trend, according to the justice, is how executive actions have increasingly replaced legislation as a means to enact new laws.<\/p>\n

\u201cThe vision of early 20th century progressives and the New Dealers of the 1930s was the policymaking would shift from narrow-minded elected legislators to an elite group of appointed experts. In a word, the policymaking would become more scientific. That dream has been realized to a large extent,\u201d Alito said.<\/p>\n

\u201cEvery year, administrative agencies acting under broad delegations of authority churn out huge volumes of regulations that dwarf the statutes enacted by the people\u2019s elected representatives. And what have we seen in the pandemic? Sweeping restrictions imposed, for the most part, under statutes that confer enormous executive discretion.\u201d<\/strong><\/p><\/blockquote>\n

Alito referenced law from Nevada that gives the governor a broad mandate to \u201cperform and exercise such functions, powers, and duties as are necessary to promote and secure the safety and protection of the civilian population\u201d in the event of a technological, natural, or manmade emergency or disaster of major proportions. https:\/\/www.zerohedge.com\/political\/justice-alito-slammed-left-after-questioning-constitutionality-covid-crackdowns<\/a><\/p><\/blockquote>\n

The fact that the US Supreme Court did NOT overrule most of the COVID restrictions shows lack of constitutional concern.<\/p>\n

If all the US Supreme Court justices actually believed that they were to defend the US Constitution and strike down laws, regulations, etc. that are in violation of it, there would not have been the type of religious gathering restrictions we saw in many states in 2020.<\/p>\n
