Poland\u2019s highest court has ruled that some EU laws conflict with the country\u2019s own constitution \u2014 a move that has raised concerns about Poland\u2019s commitment to the Union.<\/p>\n

The European Commission, the executive arm of the EU, and the conservative government in Poland have clashed for several years over the rule of law. Brussels has accused Warsaw of undermining the independence of the judicial system and has so far held back on deciding whether to disburse post-pandemic recovery funds worth about 30 billion euros ($34 billion).<\/p>\n

In the latest escalation of their dispute, Polish judges ruled, in a case brought by the country\u2019s prime minister, that national law has primacy over European rules.<\/div>\n<\/div>\n

\u201cThe Polish Constitutional Court is not the first European court to question the principle of the primacy of EU law over national law. However, it is the first time that comes from an illegally composed Court and in those rebellious terms,\u201d Alberto Alemanno, a professor of European law at H.E.C. Paris, told CNBC via email.<\/p>\n

\u201cThis frontal attack is set to backfire both in the EU, where the national recovery plan will remain unapproved, and in Poland, where Poles will start questioning their government\u2019s stance in the EU,\u201d he added.<\/p>\n

EU calls out Poland after controversial court ruling<\/h2>\n

Poland’s ruling against the primacy of EU law has sparked anger among some of the bloc’s member states. Poland’s prime minister has denied the possibility of a “Polexit.”<\/p>\n

The European Commission on Friday said it would “use all powers” under its charter to ensure respect of EU law.<\/div>\n

On Thursday, Poland’s top court said that Polish laws can take precedence over laws coming from Brussels<\/a>, further deepening a rift with the EU.<\/p>\n

“Our utmost priority is to ensure that the rights of Polish citizens are protected and that Polish citizens enjoy the benefits granted by membership of the European Union, just like all citizens of our Union,” the Commission chief Ursula von der Leyen said.<\/p>\n
